At roadside checkpoints across Taiwan, officers overwhelmingly test for one thing: alcohol. By one prosecutor's estimate, 99.9% of enforcement stops still target drunk driving, even as a new and harder-to-detect threat has spread through the country's bar and nightclub scene — drivers who have no idea they're impaired at all.
"For drug users, we try to offer deferred prosecution and get them into addiction treatment whenever we can. But driving under the influence of drugs is unforgivable — it puts other people's lives at risk," said Lin Da (林達), a prosecutor at the Taipei District Prosecutors Office. Drugged driving isn't new, Lin said, pointing to the United States, Canada, and Australia, where roadside data shows drunk driving and drugged driving occurring at roughly similar rates. In Taiwan, by contrast, enforcement has almost entirely ignored the latter — and no "zero tolerance for drugged driving" message had ever been publicly communicated, Lin said, until a recent string of fatal crashes forced the issue into view.
A New Drug for an Old Problem
Drugged driving itself isn't a new phenomenon in Taiwan, according to Lin — it just used to look different. Years ago, the substance of choice was ketamine, typically smoked in cigarette form. Today, that role has been taken over almost entirely by etomidate, delivered through what's now known on the street as a "zombie vape pod," or "K-pod": an e-cigarette cartridge loaded with etomidate instead of ordinary vaping liquid, often cut with cannabis or amphetamines.
The current outbreak, Lin said, traces largely to bars and nightclubs, where patrons casually pass around e-cigarettes without knowing what's inside them. Many users reported only that the vape "felt good" — unaware they'd inhaled etomidate, sometimes mixed with other drugs. After sharing a device, they climbed into a car or onto a scooter and drove home. That, according to Lin, is how an entire wave of impaired driving spread quietly through the nightlife scene before anyone identified it as a public health problem.

Why Roadside Testing Couldn't Keep Up
Part of what allowed the problem to go undetected for so long, Lin said, is that Taiwan simply lacked a workable field test. Urine testing isn't practical at a checkpoint, and without on-the-spot evidence, officers had no legal basis to detain a driver unless a crash had already caused injury or death. Etomidate's pharmacology made the gap worse: the drug clears the body quickly, so by the time officers found a way to test a suspected user, the result could already have turned negative.
That changed only partially late last year, when the National Police Agency imported a saliva rapid-test kit marketed as "8-in-1," giving officers their first practical roadside tool. But because etomidate is a relatively new substance on international radar, kits developed by foreign labs frequently miss it, producing false negatives. In practice, officers say they can typically only flag the most obviously impaired drivers — those already showing confusion, impaired motor coordination, or involuntary muscle tremors — while lighter users pass through undetected.
Still, having any tool at all marks progress, Lin said. A saliva rapid-test kit built specifically for Taiwan's drug landscape — commissioned by the National Science and Technology Council and Academia Sinica, and developed by Chou Cheng-ying (周呈霙), a professor in the Department of Bio-Industrial Mechatronics Engineering at National Taiwan University — is expected to reach mass production in the second half of 2026. Once available, Lin said, officers should no longer face situations where they strongly suspect impairment but have no way to prove it.
Why Lab-Grade Testing Can't Move to the Street
Some experts have pointed to liquid chromatography-mass spectrometry (LC-MS) as a more reliable alternative. But LC-MS instruments cost several million New Taiwan dollars apiece, require specially trained technicians to operate, and are entirely unsuited to fieldwork. Their proper role, Lin said, is as a back-end confirmation tool — not a roadside one.
That leaves a two-tier system as the realistic path forward: a portable saliva rapid-test kit sensitive enough to catch newer substances at the roadside, paired with an LC-MS instrument to confirm results with enough evidentiary weight to hold up in court.
Weng De-yi (翁德儀), director of the Institute of Forensic Medicine at National Taiwan University, said etomidate's short half-life makes speed essential once a driver tests positive at the roadside. Officers, she said, need to get the driver to a police station for a urine sample and rush that sample to an LC-MS-equipped lab as quickly as possible — any delay risks the drug clearing the system before the confirmatory test can run.
Weng has also flagged a procedural bottleneck that compounds the problem: current lab regulations still require two sequential steps, an initial immunoassay screening followed by LC-MS confirmation. The immunoassay method, she noted, has been in routine use for two to three decades, and the case ultimately rests on the LC-MS result regardless — making the first step, in her view, redundant for fast-metabolizing drugs like etomidate. She has called for amending the regulations to skip straight to confirmatory analysis, arguing that single-step lab results are already accepted as credible by Taiwan's courts.

What Taiwanese Law Actually Says About Drugged Driving
Contrary to a common misconception, drugged driving in Taiwan isn't a legal gray area. Article 185-3 of the Criminal Code was amended on December 8, 2013 — specifically in response to the growing problem — establishing the offense of driving without the ability to do so safely, which covers both alcohol and drug impairment under a single statute.
Lin pointed to two specific provisions: Subparagraph 3 of Article 185-3, Paragraph 1, which applies when a driver's urine or blood contains narcotics, anesthetics, or similar substances (or their metabolites) at or above thresholds set by the Executive Yuan; and Subparagraph 4, which applies when other evidence sufficiently establishes that a driver used such substances and was thereby unable to drive safely.
Penalties scale with the outcome. Under Paragraph 2, causing death carries three to ten years in prison plus an optional fine of up to NT$2 million; causing grievous bodily harm carries one to seven years plus an optional fine of up to NT$1 million. Paragraph 3 covers repeat offenders — those previously convicted, or granted deferred prosecution, under this article or Article 54 of the Military Criminal Code, who reoffend within ten years. A repeat offense causing death carries life imprisonment or a minimum of five years, plus an optional fine of up to NT$3 million; causing grievous bodily harm carries three to ten years plus an optional fine of up to NT$2 million.
Where Schools Fit In — and Where the System Still Falls Short
Age determines which system handles a case: under Taiwanese law, anyone 18 or older is treated as an adult, so a 19-year-old caught drugged driving goes to the district prosecutors office, while a 17-year-old is routed to juvenile court.
But Wang Han-yang (王瀚陽), chairman of the National Education Action Alliance (國教聯盟), points to a narrower gap in how schools handle underage e-cigarette and zombie vape pod use that never reaches the level of a driving offense. Under current practice, a school will only notify a student's juvenile protection officer if that student is already classified as high-risk — meaning they have a prior criminal record, gang affiliations, or are already under supervision. For a first-time offender showing clear physical signs of drug use, such as tremors or muscle rigidity, the school's response is more limited: confiscate the device and any suspected substance, notify the parents, alert the local health and education bureaus, and activate the school's three-tier counseling protocol.
Lin argues the government needs to do more than enforce the law after the fact. A public "zero tolerance for drugged driving" message needs to reach both teenagers and the general public, he said, and inmates convicted on drug-related charges should receive stronger legal education while incarcerated — specifically, the message that after using drugs, particularly combinations of substances, they cannot safely drive for at least five days. Unlike alcohol, which mostly clears the body after a night's sleep, drug residues — especially from mixed substances — can linger in the system and impair cognitive function for up to five days.
Treating Addiction, Punishing Endangerment — Not the Same Thing
Lin draws a sharp line between how the law should treat drug users and how it should treat drugged drivers. Taiwan's legal and medical communities increasingly view simple addiction as a chronic condition that responds to treatment, he said, and routinely jailing addicts tends to backfire: prison exposes them to networks where they learn how to obtain drugs more cheaply, often leaving them with stronger ties to the drug supply than when they went in.
Drugged driving, in Lin's view, belongs in an entirely different category. Choosing to get behind the wheel after using drugs endangers not just the driver but everyone else on the road — behavior he argues demands strict punishment, both to deter future offenses and to deliver justice to victims.
