The Japanese government has launched a legal review to determine whether it can deploy the Self-Defense Forces (SDF) to escort commercial vessels through the Strait of Hormuz. The move comes as Iran's effective blockade of the strategic waterway and mounting pressure from U.S. President Donald Trump push Tokyo toward a difficult policy decision.
The review precedes Prime Minister Sanae Takaichi's scheduled March 19 visit to Washington for high-level talks with U.S. officials. The outcome of those discussions is widely expected to influence the trajectory of ongoing U.S.-Japan trade negotiations.
A shift in Tokyo's stance
Unlike several European nations that have publicly rebuffed Washington's requests for military backing in the Middle East, Japan is adopting a more cautious approach. Takaichi initially declined to commit to an SDF dispatch, but she signaled a shift in her position during a March 17 upper house budget committee session.

According to theAsahi Shimbun, Takaichi told lawmakers she has directed her cabinet to assess what actions the SDF may legally take under existing Japanese law. She outlined potential mission options, including minesweeping, vessel escorts, support for allied forces, and expanded intelligence gathering.
“We are confirming whether there is a legal basis, taking stock of what is actually happening in the Strait of Hormuz and comprehensively clarifying what Japan can and cannot do,” Takaichi said.
Gauging Washington's objectives
To better understand the scope of the U.S. request, top Japanese officials have initiated direct dialogues with their American counterparts.

Foreign Minister Toshimitsu Motegi spoke by phone with U.S. Secretary of State Marco Rubio, emphasizing the critical importance of freedom of navigation through the Strait of Hormuz to Japan's energy security. Takaichi subsequently received briefings from both ministers at the prime ministerial residence, aiming to clarify Washington's strategic intentions and the limits of its expectations.
The official government position holds that the ongoing crisis does not meet the legal threshold to justify invoking collective self-defense rights. The conflict also does not qualify under the framework that allows Japan to provide logistical support to U.S. forces.
Officials have broadly indicated that deploying the SDF under either legal basis would be extremely difficult while U.S. and Iranian forces are actively exchanging fire.
Exploring alternative legal pathways
The debate has shifted toward whether a "maritime security operation" order under the Self-Defense Forces Act could provide a viable alternative. Takaichi acknowledged that such a determination would be "quite difficult under existing legal interpretations."
However, Defense Minister Koizumi offered a more flexible reading. He told the upper house that the current framework could permit SDF vessels to deploy under a maritime security operation specifically to protect ships with direct ties to Japan. Koizumi elaborated that while this operation is fundamentally a police-powers mechanism—not designed for using weapons against foreign military forces—it does "not exclude the possibility of using weapons for self-protection."

Koizumi's remarks indicate that the government is actively exploring interpretive room within existing statutes to build a legally and politically defensible case for an overseas deployment.
Despite the prime minister's apparent openness to sending forces, a formal decision remains pending. Chief Cabinet Secretary Minoru Kihara told reporters that the government will give "careful consideration" to the U.S. request, but that no final determination has been made.
